In Which I Was Quite Wrong About a Thing (Volume 1)

posted on 1/23/2019 by the Salt City Sinner Crow! Nobody likes to eat it. For one thing, corvids are highly intelligent and social animals, and for another they taste awful (or so I’ve heard). That said, I’m a fellow who prides myself on my ability to admit when I’m wrong, and thus I present an instance (one of many, but we’ll tackle them one at a time) when I’ve been wrong. Mostly. The year was 2015 ! The newfangled “jazz music” craze was ripping up the airwaves, and women were wearing short skirts and voting! In actuality, 2015 only feels like 100 years ago, due to the horrific time distortion field we’ve been living in recently. Here’s what I had to say then about Senator Mark Madsen’s attempts to decriminalize the devil’s lettuce for medical use:   I will not argue for a single second that [2015’s failed legalization effort] isn't progress – it is. And Senator Mark Madsen's bill regarding medical marijuana only failed by a single vote.  …All of that as...

An Open Letter to the Utah State Legislature Regarding House Bill 372: (Utah Bill to Tax E-Cigarettes and Ban Online Sales)

posted 3/9/2013 by Crazypoliticos In their latest effort to make the world a more terrible place the Utah House of Representatives stands poised to pass HB-372, which passed out of the Utah House Health and Human Services Committee on March 6, 2013. This proposed legislation seeks to tax e-cigarettes at 86% of the manufacturer's price and make purchasing e-cigarettes online or through the mail a criminal offense. Hello Utah! Really? Let me explain. I'm a former smoker who hates cigarettes. I hate the odor. I have asthma and occasionally have a severe reaction to cigarette smoke. I detest cigarette buttes left everywhere. Smokers are not supposed to smoke in prohibited places such as bus and Trax stops. Smokers are not supposed to throw their butts everywhere. They do. They do and anyone who lives in an urban apartment building or takes public transportation knows this. They smoke inside their apartments. They drive and smoke with you in the car. Smoking is a terrible addicti...

Federalism 101.1 - Equal Footing Doctoring

Posted 9/15/2012 by Law Nerd Remember Rep. Sumsion from American Fork, who not long ago threatened to kick the federal government's toys out of the Utah public lands sand box?  Well I thought I'd check in on our friend, follow up on the bill, and stick a thermometer in the armpit of the nation to gauge the reaction, or lack thereof.  Survey says: Utah's attempt to wrest control over federal public lands within its borders is either being ignored, or has fallen on deaf ears. When last I wrote  about Rep. Sumsion, he had sponsored a bill demanding that the federal government either sell off its public lands in Utah or cede control of them to the Utah government.  This was based on language in the Utah Enabling Act dictating that the federal government would pay to Utah 5% of the proceeds from the sale of public lands within its borders.  Since then, Sumsion's bill, H.B. 91, morphed into First Substitute H.B. 91  (H.B. 91 S. 1).  Now the Utah Legisla...
